No single yes or no exists. The honest answer is the structure that decides your case.
There is no blanket answer. Refundability turns on three things: what your contract says, whether the money sits in the registered escrow account, and the conditions under which that account releases funds.
A deposit paid outside the registered account loses the protections the escrow regime exists to provide. That one fact decides more refund outcomes than any clause.
